Policies, Terms & Conditions

These Policies, Terms & Conditions (“Policies”) govern all access to and use of the Porco e Vaca website, mobile application, and related services (collectively, the “Services”), as well as all orders placed with Porco e Vaca (“we,” “us,” or “our”). By accessing our Services or placing an order, you (“Customer”) acknowledge that you have read, understood, and agree to be bound by these Policies and our Privacy Policy. If you do not agree, please discontinue use of our Services immediately.
We are committed to transparency, fairness, and honest dealing in every interaction. Our Policies are written to protect both our customers and our business equally. We ask that you read them carefully.
1. Eligibility and Account Responsibility
To place an order or create an account with Porco e Vaca, you must be at least 18 years of age and legally capable of entering into binding contracts under applicable law.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorized access to your account, you must notify us immediately. We reserve the right to suspend or terminate accounts that show evidence of unauthorized use, fraud, or violation of these Policies.
2. Orders, Pricing, and Payment
2.1 Order Acceptance
All orders are subject to acceptance and product availability. Submitting an order constitutes an offer to purchase; your order is accepted when you receive a written order confirmation from us. We reserve the right to decline or cancel any order at our discretion, in which case we will promptly notify you and issue a full refund of any amount charged.
2.2 Pricing
All prices are displayed in U.S. Dollars (USD). Prices are subject to change without prior notice; however, the price displayed at the time your order is confirmed is the price you will be charged. Applicable taxes, delivery fees, setup fees, and any refundable deposits will be itemized and presented to you at checkout before payment is completed.
2.3 Payment Authorization
By placing an order, you represent that you are the authorized holder of the payment method provided and you authorize us to charge all amounts due, including the order total, applicable taxes, fees, deposits, and any Damaged Goods fees described in Section 5. Payment is captured at checkout. We accept all major credit and debit cards. We do not store full payment card data on our servers.
2.4 Advance Ordering and Last Call
Due to the perishable, custom nature of our products, advance ordering is required. Our Last Call for weekend deliveries is 5:00 PM every Thursday. Same-day orders may be accommodated at our sole discretion and subject to availability. We strongly encourage customers to plan ahead to ensure product quality and on-time delivery.
3. Cancellations and Modifications
3.1 Customer-Initiated Cancellations
Because our products are perishable and often custom-configured, cancellations and modifications must be requested no later than 72 hours (3 full calendar days) before the scheduled delivery or event date. Cancellation requests submitted within this window will be reviewed and accommodated where possible.
Cancellations requested after the 72-hour window has closed or once ingredient procurement and preparation have commenced will not be accepted, and no refund will be issued. This policy exists because perishable ingredients are sourced specifically for your order and cannot be returned or resold.
3.2 Order Modifications
Modification requests (changes to board configuration, size, delivery time, or address) must also be submitted no later than 72 hours before your scheduled delivery. We will make reasonable efforts to accommodate requests; however, modifications are not guaranteed and are subject to ingredient availability and preparation status at the time of the request.
3.3 How to Request a Cancellation or Modification
All cancellation and modification requests must be submitted in writing via the website chat, the mobile app, or email to our customer support team. Please include your order number and the specific change or cancellation you are requesting. Verbal requests cannot be accepted. We will confirm receipt and advise on the status of your request promptly.
3.4 Company-Initiated Cancellations
In the rare event that we must cancel your order due to circumstances beyond our control (including supply unavailability, adverse weather, or force majure events), we will notify you as soon as possible and issue a full refund. We will make every reasonable effort to offer a rescheduled delivery as an alternative.
4. Delivery, Setup, and Risk of Loss
4.1 Delivery Area and Windows
Porco e Vaca currently delivers exclusively within the city of Weston, Florida. Our service area is subject to change; please verify current delivery zones on our website before placing your order. Delivery windows will be communicated at checkout and in your order confirmation. We will make every reasonable effort to deliver within the confirmed window.
4.2 Customer Responsibilities at Delivery
You are responsible for providing accurate and complete delivery information at the time of ordering. Someone must be available to receive the delivery at the confirmed location and time. If no one is available to receive your order and we are unable to complete delivery, we will contact you; however, we cannot guarantee a re-delivery, and the original delivery fee will still apply.
4.3 Setup Services
Medium, Large, and Extra-Large boards require on-site setup by our team before they are ready to serve. Setup will be completed at the confirmed delivery location. Small boards arrive fully assembled and ready to serve, and are yours to keep.
4.4 Risk of Loss
Risk of loss for all delivered products passes to you upon delivery or upon completion of setup, whichever is later. We are not responsible for products that are left unattended, improperly handled, or stored after delivery. Please refrigerate or consume perishable items promptly following our guidance.
4.5 Delivery Fees
Delivery fees are calculated based on order size, configuration, and delivery location and will be displayed at checkout before payment is completed.
Delivery fees are non-refundable once a delivery has been completed.
5. Proprietary Boards, Deposits, and Damaged Goods
5.1 Ownership of Boards and Accessories
Certain boards and accompanying accessories (collectively, “Proprietary Items”) remain the sole property of Porco e Vaca at all times. Proprietary Items are made available to you on a temporary basis for use at your event and must be returned to us in accordance with this Section.
5.2 Refundable Deposit
A refundable security deposit will be collected at checkout for all orders that include Proprietary Items. The deposit amount will be clearly disclosed before payment is completed. The deposit will be refunded in full within a reasonable time after pickup and satisfactory condition inspection, provided no damage, loss, or non-return has occurred.
5.3 Pickup of Proprietary Items
We will collect Proprietary Items on the next business day following your event (or the first business day after a weekend or holiday). You are responsible for ensuring that all Proprietary Items are available, accessible, and in the same condition as delivered at the agreed pickup time. Failure to make items available for pickup will be treated as a non-return and subject to fees as described in Section 5.4.
5.4 Damaged Goods and Non-Return Fees
You are responsible for safeguarding all Proprietary Items from the time of delivery until the time of pickup. If any Proprietary Item is lost, stolen, unreturned, or returned with damage beyond normal wear and tear, we reserve the right to assess a Damaged Goods fee.
Normal wear and tear means minor, superficial marks or scuffs consistent with appropriate food service use. Damage beyond normal wear includes, without limitation: cracks, gouges, burns, staining that cannot be cleaned, broken components, or items that are not returned.
By placing an order, you expressly authorize us to charge any applicable Damaged Goods fee to the same payment method used for the original purchase. We may retain all or part of the deposit and/or charge an additional amount if repair or replacement costs exceed the deposit. All fees will reflect documented, reasonable repair, cleaning, refurbishment, or replacement costs.
6. All Sales Final - Refund and Return Policy
6.1 All Sales Final
Due to the perishable, custom, and time-sensitive nature of our products and services, all sales are final. We do not accept returns, provide exchanges, or issue refunds for delivered orders, except as expressly described in this Section or as required by applicable law.
6.2 Claims for Defective or Incorrect Orders
If you believe your order was materially defective, incorrect, or that we failed to fulfill a confirmed order specification, you must contact us promptly, and no later than 24 hours after delivery, with your order number and clear photographic documentation. We will evaluate all claims in good faith and, at our discretion, may offer a remedy such as a replacement item, store credit, or other accommodation.
Claims submitted more than 24 hours after delivery, or without adequate documentation, may not be considered. Dissatisfaction with personal taste preferences or minor aesthetic variations does not constitute a defect and is not grounds for a refund or credit.
6.3 Deposit Refunds
Refundable deposits for Proprietary Items will be returned following successful pickup and condition inspection as described in Section 5. Deposits will not be refunded if items are damaged, lost, or not made available for pickup.
7. Food Safety, Allergens, and Dietary Accommodations
7.1 Allergen Disclosure
Our boards contain or may contain common allergens including, but not limited to: dairy, gluten (wheat), tree nuts, peanuts, soy, eggs, sesame, and sulfites. Our kitchen is a shared preparation environment. While we take reasonable precautions, we cannot guarantee that any product is free from cross-contact with allergens.
Customers with severe or life-threatening food allergies are strongly encouraged to contact us directly before placing an order so we can advise on the suitability of our products for their specific needs. By placing an order, you acknowledge and accept this allergen risk.
7.2 Dietary Accommodations
We offer vegetarian and vegan board options and can build gluten-free configurations upon request. Dietary accommodation requests must be clearly specified at the time of ordering. We will make reasonable efforts to fulfill such requests; however, accommodations are subject to ingredient availability and cannot be guaranteed to be free of cross-contact in our shared kitchen environment.
7.3 Food Safety and Consumption
All boards are prepared fresh using cold-chain protocols and delivered in food-safe packaging. For best quality and food safety, perishable items should be consumed within the timeframes indicated on your order confirmation and product documentation. We are not responsible for illness or quality degradation resulting from improper storage or handling after delivery.
8. Intellectual Property
All content on our website, application, and marketing materials, including text, images, photographs, brand names, logos, board designs, and recipes is owned by or licensed to Porco e Vaca and is protected by applicable intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works from any of our content without our prior written permission.
If you post reviews, photographs, or other content featuring our products on our Services or social media platforms and tag or reference us, you grant Porco e Vaca a non-exclusive, royalty-free, worldwide license to use, display, and share that content for promotional and marketing purposes, with attribution where practicable.
9. Limitation of Liability and Indemnification
9.1 Limitation of Liability
To the fullest extent permitted by applicable law, Porco e Vaca shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, products, or these Policies, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from a specific order or transaction shall not exceed the total amount paid by you for that specific order, to the extent permitted by law.
9.2 Indemnification
You agree to indemnify, defend, and hold harmless Porco e Vaca, its owners, employees, agents, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of our Services; (b) your violation of these Policies; (c) your violation of any applicable law or third-party right; or (d) any claim that content you submitted caused harm to a third party.
10. Privacy Policy
10.1 Information We Collect
We collect information you provide directly when creating an account or placing an order, including your name, delivery address, email address, phone number, and payment details. We also collect information about your orders and preferences, communications you send us, and technical data such as your device type, IP address, and browser information.
10.2 How We Use Your Information
We use your information to: process and fulfill orders; communicate order status, confirmations, and updates; respond to inquiries; improve our Services and product offerings; prevent fraud and unauthorized use; comply with legal obligations; and, with your consent, send promotional communications about our products and offers. We may aggregate or de-identify data for internal analytics and business planning.
10.3 Data Sharing
We share your personal information only as necessary with trusted third-party service providers who perform functions on our behalf, including payment processors, delivery logistics providers, and analytics platforms. These providers are contractually required to handle your data securely and only for the purposes for which it is shared.
We may disclose your information to comply with applicable law, legal process, or government requests; to enforce these Policies; or to protect the rights, safety, or property of Porco e Vaca, our customers, or others. In the event of a business acquisition, merger, or asset sale, your information may be transferred as part of that transaction.
We do not sell your personal information to third parties for their independent marketing purposes.
10.4 Cookies and Tracking Technologies
We and our partners use cookies and similar tracking technologies to operate and analyze our Services, remember your preferences, and deliver relevant content. You may manage or disable cookies through your browser settings; however, doing so may limit certain features or functionality of our Services.
10.5 Data Retention and Security
We retain your personal data for as long as necessary to provide our Services and comply with applicable legal obligations. We implement reasonable administrative, technical, and physical security measures to protect your data. However, no internet-based system is completely secure, and we cannot guarantee absolute security. In the event of a data security incident, we will take prompt remedial action and notify affected individuals as required by law.
10.6 Your Privacy Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of your personal data, or to receive a copy of your data in a portable format. To exercise any of these rights or to raise a privacy concern, please contact us using the contact details provided on our website. We will respond within the timeframe required by applicable law.
11. Digital Products
11.1 License
Any digital products or content offered by Porco e Vaca, including but not limited to guides, recipe downloads, classes, or streamed content are licensed, not sold, for your personal, non-commercial use only, unless expressly stated otherwise. You may not copy, distribute, sublicense, or resell digital content without our prior written permission.
11.2 Access and Delivery
Access to digital products will be granted via account login, download link, or streaming, as specified at purchase. All digital sales are final once access has been provided or a download has been initiated, except where otherwise required by applicable law.
11.3 Termination of Access
We reserve the right to suspend or permanently terminate access to digital products in cases of Terms violation, fraud, unauthorized sharing, or misuse of content. Refunds in such cases are not guaranteed and will be evaluated at our sole discretion.
12. Prohibited Conduct
When using our Services, you agree not to: (a) provide false or misleading information in connection with any order or account; (b) use our Services for any unlawful purpose; (c) attempt to circumvent any security measure or access any part of our systems without authorization; (d) engage in fraudulent chargebacks or payment disputes without first contacting us in good faith; (e) harass, threaten, or abuse our staff or representatives; or (f) reproduce, distribute, or exploit our intellectual property without permission.
We reserve the right to refuse service, cancel orders, or terminate accounts of any customer who engages in prohibited conduct, without liability.
13. Chargebacks and Disputes
We are committed to resolving any concerns fairly and promptly. Before initiating a chargeback or payment dispute with your bank or card issuer, we ask that you contact our customer support team directly so we have the opportunity to address your concern. Fraudulent or unjustified chargebacks, particularly for orders that were delivered as confirmed constitute a violation of these Policies and may result in account termination and referral for collections or legal action.
14. General Provisions
14.1 Policy Updates
We may update these Policies at any time. Updated Policies will be posted on our website with a revised Effective Date. Your continued use of our Services after updated Policies are posted constitutes your acceptance of the changes. We encourage you to review these Policies periodically.
14.2 Governing Law
These Policies are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Policies shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.
14.3 Dispute Resolution
Before pursuing formal legal action, both parties agree to attempt resolution through direct negotiation in good faith. If a dispute cannot be resolved informally within 30 days, either party may pursue remedies available under applicable law. Nothing in these Policies prevents either party from seeking emergency injunctive or equitable relief.
14.4 Severability
If any provision of these Policies is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions will continue in full force and effect.
14.5 Entire Agreement
These Policies, together with any order confirmation and additional terms presented at checkout, constitute the entire agreement between you and Porco e Vaca regarding your use of our Services and supersede all prior agreements, understandings, or representations on the same subject matter.
14.6 No Waiver
Our failure to enforce any right or provision of these Policies on one occasion shall not be construed as a waiver of our right to enforce such provision on any other occasion.
